Description

Prosecutors and victim advocates regularly find themselves working criminal cases in which the defendant is being prosecuted for criminal acts against the defendant's current or former partner and/or the defendant's minor child(ren), and the defendant (or an agent of the defendant) is also — or will soon become — a party to a family court case in which the alleged criminal acts will play a major role in determining child custody. This presentation will shed some light on the various ways in which criminal law and family law intersect and how County Attorney staff can help to promote the safety of children in the civil legal context.

Defenders of Children


David Newstone is the Interim Executive Director and General Counsel of Defenders of Children, which has been providing free trauma-informed and healing-focused legal services to vulnerable children and their families throughout Arizona since 2007. Prior to joining Defenders of Children, Mr. Newstone practiced law in the public interest at Southern Arizona Legal Aid, Inc., and the William E. Morris Institute for Justice. Throughout his career, Mr. Newstone has successfully represented hundreds of low-income clients in counties and tribal nations across Arizona; contributed accessible legal content to numerous statewide programs and resources for self-represented litigants; and trained countless other attorneys, legal advocates, case managers, law enforcement officers, and others in crime victims’ rights and in family law, with a focus on child custody issues and orders of protection.
